ISRA Compliance Consulting

In New Jersey, the Industrial Site Recovery Act (ISRA) requires owners or operators of certain industrial and commercial establishments who are planning to transfer ownership, to substantially change operations, or to close a facility to notify the New Jersey Department of Environmental Protection (NJDEP) and conduct an environmental assessment of the facility. New Jersey’s recent adoption of the Site Remediation Reform Act makes a thorough understanding of the requirements of the ISRA process even more essential in successfully completing a property transaction.

ENVISION has experience in all phases of the ISRA process, including the steps necessary to allow a property sale to be carried out in compliance with ISRA. In some cases, approval of a Remedial Action Workplan by the NJDEP is a pre-condition for closure or property transfer.

ENVISION can help with the following ISRA issues:

  • Determination if ISRA applies
  • When ISRA is triggered and what requirements must be met
  • Fees and notices (General Information Notices, Public Notification, etc.)
  • Compiling and completing the application form and supporting documentation
  • Preliminary Assessments (PA) identifying Areas of Concern (AOC)
  • Site Investigation (SI) – determining if any contaminants are present above remediation standards
  • Remedial Investigation Reports (RIR) and Remedial Action Workplans (RAW)
  • Negative Declarations
  • Limited Conveyance Applications
  • Remediation Permits
  • Alternative Compliance Options

ENVISION’s aim is to guide our clients’ transactions through the process without costly delays from not complying with regulatory requirements.
